1. Acceptance of Terms of Use and Service

Thank you and welcome to RentMeAHandbag.com and other domain names that RentMeAHandbag.com may use to operate our services. These Terms of Use and conditions govern your use of our site, service and sale of products. By accessing, browsing or using this site or any of the Service, you agree and accept these Terms of Use, conditions and any modifications that may be made to the Terms of Use and Condition from time to time. You also agree and accept all operating policies of RentMeAHandbag.com that may be published on this site.  Do not access, browse or use this site if you do not agree to and accept these Terms of Use and Conditions.

Read this entire agreement carefully as These Terms of Use and Conditions constitute a binding legal agreement between you and RentMeAHandbag Inc. In this agreement, "you," "Renter" or "your" means any person renting or using any of our other services offered at RentMeAHandbag.com, or any person or entity registered and/or signing or signed up for  Membership ("membership"), and "we", "our", or "us" means RentMeAHandbag Inc.

2. RentMeAHandbag LLC Reserve the Right to revise this agreement

We reserve the right to update, revise, and supplement these Terms of Use and Condition at any time. We may also decide to add new rules, policies or terms.  Any such revisions, update or changes will be effective immediately with notification.  The notification is made by posting such changes on this site.  Your continued use of the Site after such notice shall be deemed your binding acceptance of such revisions. You can cancel your account or notify us immediately to cancel your account if you do not agree to changes (You must return all items on rent from us first.) RentMeAHandbag Inc reserves the right, at any time, to revise, temporarily or permanently, our service.  You agree not hold RentMeAHandbag Inc or any of its associates liable for such revisions.  We also reserve the right to deny or restrict service to any one at our sole discretion.

3. Item Collections:

We offer four collections of fashion items. Runway, Platinum, Gold and Silver.
Runway Collection features the most exclusive items we carry. Silver Collection features the least exclusive items we carry.  Members and Non-members can rent or place items on Layaway from any of the collections.
            RUNWAY COLLECTION: We will conduct additional review of interested renters
              prior to renting them items from this collection.
            PLATINUM, GOLD AND SILVER COLLECTIONS:  These collections are also open to both
              members and non-members for rent and layaway.  (INTERNATIONAL CUSTOMERS CAN
              ONLY RENT FROM THE SILVER LEVEL. YOU CAN CONTACT US TO LIFT THIS
               RESTRICTION)

4.1 RentMeAHandbag Inc. Services: Rental

Our Service allows registered users to access the Site for the purpose of renting items from RentMeAHandbag.com in accordance with these Terms of Use and Conditions. There are no registration fees.  We rent to both members and non-members.

MEMBERSHIP: There is a $9.95 monthly membership fees. This fee can be paid yearly, twice a year, quarterly or monthly. 
            1 year membership fee is $99.95             6 Months membership fee is $54.95 
            3 Months membership fee is $27.95        1 Month membership fee is $9.95
           

MEMBERSHIP BENEFITS

RENTAL PROCESS: Choose an item from the rental part of our website. Click on "Details" to go to the details page.  If you are member, click on the "Rent It" associated with "Member Preferred Price" If you are a non-member, click on the "Rent It" associated with "Non- Member Guest Price" (Non members can upgrade to membership and obtain the same discounts as members) This action takes you to the "Order Page."  On the "Order Page," choose weekly or monthly rental period.  (Our monthly rental fee reflects a 50% off the regular fee.) Enter any promotional code if applicable.
Next, choose your shipping method from the drop down menu. (Shipping is Free for members) If a member wants overnight shipping the member will be charged for this service.  Next, enter or choose your shipping address and billing information.  Next, accept or decline the optional insurance. (Insurance only covers for excessive wear. It does not cover damage, lost or stolen item.) Click on the "Review Order" button at the bottom of the page.   Review your order and charges on the "Review Order" page. Check the box to show you agree to our terms and condition. Finally, click on the "Place Order" button.
Please note that you will have to go through this rental process for each item being rented. Also, each item will be shipped separately. You can rent items weekly or monthly. As long as the weekly or monthly fees are paid, you can rent these items for weeks, months or years.

            HOLDING CHARGE:  There is a small refundable "Holding Charge" associated
            with each item rented.  This charge is refunded if the item is returned in an acceptable
            condition with normal wear as determined by RentMeAHandbag Inc.  If you treat our
            item the  way a normal person will treat an item borrowed from their family member or
            friend, you should be within the "Acceptable Condition" We may choose not to refund
            the Holding Charge if the item is excessively worn. We recommend buying the optional
            insurance to cover for excessive wear.  If the item is damaged or stolen, we may use
            the Holding Charge as part of the payment for the loss. We may also charge your credit
            card to cover for the loss.  Our charge for the loss will be based on the retail value and
            usage of the item. Contact us immediately, if the item is damaged or stolen.
            NOTE: RentMeAHandbag, at its' sole discretion, may waive this Holding Charge
            requirement for certain members.

BUYING AN ITEM THAT I AM CURRENTLY RENTING: You can buy an item that you are currently renting by going through the following steps: Log in to your account.  Click on the "Overview" tab. The items that you are currently renting will show under the "Current Rental" sub-heading. Click on the "Buy it" button associated with the item you wish to buy. This takes you to the Buy it page where you can enter your shipping and billing information. If you are a non-member, you can upgrade to membership and receive the discounts reserved for members.  This discount will be applied beginning with this purchase. Once you've entered your shipping and billing address, click on "Review Order" button at the bottom of the page. The next page gives you the review of your price. Finally, click on "Buy This Item" button to make the purchase.
Note that your Holding Charge is applied towards the purchase, and your card only charged the difference.
           

4.2 RentMeAHandbag Inc. Services: Buy It

BUY IT PROCESS:  This process allows you to buy outright an item that you see on the rental part of our website. The process is similar to the rental process. Choose an item from the rental part of our website. Click on "Details" to go to the details page.  Click on the "Buy It."  This action takes you to the "Order Page"  On the "Order Page," members will click on the "Member" Buy It Now button.  Non-members will click on the "Guest" Buy It Now.  Non-members also have the option of upgrading to membership to obtain the discounts available to members.  
Next, choose your shipping method from the drop down menu. (Shipping is Free for members) If a member wants overnight shipping the member will be charged for this service.  Next, enter or choose your shipping address and billing information. Click on the "Review Order" button at the bottom of the page.   Review your order and charges on the "Review Order" page. Check the box to show you agree to our terms and condition. Finally, click on the "Place Order" button.
Please note that you will have to go through this process for each item that you want to buy. Also, each item will be shipped separately.
NOTE: All items in all Collections from Runway to Silver are available for purchase to anyone.

4.3 RentMeAHandbag Inc Services: Layaway

LAYAWAY:  This process allows you to make three monthly installment payments towards the purchase of an item. Choose an item from the rental part of our website. Click on "Details" to go to the details page.  Click on the "Layaway" Member button if you are member. Click on the "Guest" button if you are a non-member.  Guests can upgrade to member and obtain the same discounts as a member. Next, choose your shipping method from the drop down menu. (Shipping is Free for members) If a member wants overnight shipping the member will be charged for this service.  Next, enter or choose your shipping address and billing information. Click on the "Review Order" button at the bottom of the page.   Review your order and charges on the "Review Order" page. Check the box to show you agree to our terms and condition. Finally, click on the "Place Order" button.
Please note that you will have to go through this process for each item that you want to put on Layaway.  If you are unable to fulfill the full three installments or cancels, we will refund all monies paid less 15% stocking fee. (15% of your purchase price)
NOTE: All items in all Collections from Runway to Silver are available for Layaway to anyone

5. INSURANCE:

We include shipping insurance to cover damage or loss during shipping. You are notified via E-mail once the item is shipped. You are responsible once the tracking information shows that you have signed for it. You may choose to purchase optional insurance in the "Order Page" to cover for excessive wear or damage while the item is in your possession. Our shipping, and return policies are stated on this site.

You agree to forfeit the Holding Charge to RentMeAHandbag Inc if the item is returned in a dirty condition or beyond normal wear as determined by RentMeAHandbag Inc. This does not apply to those that purchased insurance from RentMeAHandbag Inc.  We recommend the purchase of insurance if you believe excessive wear may result. You also agree to forfeit to RentMeAHandbag the Holding Charge if the item is damaged or stolen. You agree that RentMeAHandbag can charge your credit card if the Hold Charge is not sufficient to cover the replacement value of the item.  The replacement fee depends on the individual item. This replacement fee is determined by RentMeAHandbag Inc based, among other things, on the retail price and item usage.

6. SHIPPING

You must return the same products you were sent. Please include all the packages and material that came with the item; Authenticity cards, envelopes, studs, dustbags, box, tissues etc.  We have visible and invisible measures to ensure that the item you return is the same that was sent you. Immediately upon shipment of any Product to you, after the item has left our storage and shows to have been signed for by you or your agent, any and all liability for the Product's loss or damage passes to you, until it has been returned by you to us, and has been inspected and verified that it was returned in an acceptable condition.  To maintain our free domestic shipping policy (members only), you agree to use the packaging provided on delivery to return the product, and to ensure adequate protection. Delivery time for rented items varies, depending on different factors including your address, Signature requirement, unforeseen circumstances in shipping service and other circumstances. We will send you an e-mail with a tracking number letting you know when your Product is shipped and the expected delivery time.

7. Membership Registration and Account

You are required to register in order to rent or place items on Layaway from the site. You must be 18 years of age or older to rent from us. We may perform Identity Verification on all members for our security and for the security of the payment method account provided by you.  We reserve the right to deny service if you do not meet our Identity Verification standards, or for any or no reason at our discretion. All items rented to you remain the property of RentMeAHandbag Inc unless otherwise specified.  We will transfer ownership of items only if we receive full payment for them, and we reserve the right to deny any offer to purchase one of our items, or to deny you the right to rent any one of our items. You agree to provide current, correct and complete information as required in the registration form. You are responsible for ensuring that your E-mail, phone, credit card, shipping address and more are all current. You also agree to keep such information up to date. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have any reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your account and refuse to offer you any and all current or future use of the Service and the Site.  You are responsible for maintaining the security and confidentiality of your account, password and access to your computer. You are entirely responsible for any activity related to your account. You agree to notify us immediately If you suspect any unauthorized use of your account. You also agree that RentMeAHandbag Inc will not be responsible for any loss from breach of account or password security.

8. Billing

A credit card that you are authorized to use is required to rent from us or place items on Layaway. By signing up for the Service, you authorize RentMeAHandbag Inc or its agent to bill your credit card the applicable  rental fees, (shipping charges FOR Non-Members and INTERNATIONAL CUSTOMERS ONLY or as described in this terms and condition),  and all applicable taxes, and any other charges you may incur in connection with your use of the Service. The applicable rental fees will be charged to your credit card on the date you initiate your rental. All renters will be billed immediately. The next billing cycle for weekly renters is 15 days after you placed your initial order. The next billing cycle for monthly renters is 38 days after you placed your initial order.  The next billing cycle of International renters is 42 days after your initial order. Billing continues at the same rate and frequency until change in rental period, cancellation or termination. These billing cycle allows you extra FREE days to enjoy the item beyond your weekly or monthly period.

There is continuous automatic monthly or weekly (depending on the rental period chosen) Service billing for renters until you return the item and all other terms are met. Your rental will be automatically renewed, and your Payment Method will be automatically billed on a monthly or weekly basis (depending on the rental period chosen), until such time as you cancel that rental by returning the item, change your rental options or we terminate your registration as outlined in this terms and conditions. Your agreement to these Terms constitutes notice of, and your acceptance of, automatic renewal and automatic monthly or weekly billing as applicable.  RentMeAHandbag Inc will bill the applicable fee plus any applicable taxes to the Payment Method you provide us at registration, or to a different Payment Method should you change to another Payment Method, if and when such a method is acceptable to us.

By signing up for a rental , you agree that RentMeAHandbag Inc is permitted to charge, debit, request funds from, as applicable, your Payment Method all corresponding subscription fees,  insurance fees, replacement or damage fees, or any other fees arising from your use of and/or membership with RentMeAHandbag Inc.  You agree that RentMeAHandbag Inc is not responsible for any additional bank fees, service charges, interest charges, overdraft charges, finance charges or any other fees you may incur resulting from the use of our service, or the Site. 

If RentMeAHandbag Inc does not receive payment from your credit card provider or if your credit card expires or is rejected, you agree to pay all amounts due upon demand. RentMeAHandbag Inc will block your account if your credit card is declined.  You have seven days to update your credit card information. You must log in to your account, go to the "Rental History" page and update your credit card information. (You can only update your credit card information while your account is blocked.) Once our system determines that your updated credit card is valid, your account will be available for use.  If your account is not updated within seven days, you forfeit the Holding Charge.  If it is more than 7 days, contact us to re-activate your account. There is a $15.00 re-activation fee. RentMeAHandbag Inc reserves the right to take all steps necessary to collect amounts due from you, including but not limited to using third party collection agencies. RentMeAHandbag Inc reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

9. Cancellations

CANCELLATION OF REGISTRATION: Cancellation of  Registration means ending your registration to our site, and will no longer be able to rent or access our site to use any of the functions that requires registration as outlined in this terms and condition.   To cancel your access and membership to our service, a cancellation request must include both an e-mailed request to  customercare@rentmeahandbag.com and tracking information for the return to us by you of any and all rented items.  Upon receiving a complete request to cancel and upon receipt all outstanding rented products on loan to you, or payment for any and all unreturned damaged products as set forth in this Agreement, RentMeAHandbag Inc will terminate your recurring rental and/or membership fees. NO REFUNDS OR CREDITS WILL BE GIVEN FOR ANY UNUSED PARTIAL monthly rental fees.  Within seven (7) days from the date you give us complete notice of cancellation as set forth above, We must receive delivery of any and all borrowed items, or you must satisfy any payments for any unreturned or damaged Products as stated in this Agreement. If the rented items are not returned, we will continue to bill your payment method. All replacement costs are determined at RentMeAHandbag Inc sole discretion.  If you do not pay for the replacement cost of an outstanding product, we will continue to bill you for weekly or monthly fees until a replacement charge is paid for, and RentMeAHandbag Inc may use 3rd parties including, such as collection agencies or other services or individuals, to collect outstanding fees, unreturned products, replacement costs, or charges.  You may also be responsible collection cost including attorneys' fees incurred by us in trying to obtain payment from you.

10. Privacy

Any information submitted on the Site is subject to our Privacy Policy, the terms of which are incorporated into these Terms of Use and Condition.

11. Disclaimers of Warranties; Limitations on Liability

DISCLAIMER OF WARRANTY. RentMeAHandbag Inc PROVIDES THE SERVICE AND THE SITE ON AN "AS IS" AND "AS AVAILABLE" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, IN ANY COMMUNICATION WITH RentMeAHandbag Inc OR ITS REPRESENTATIVES, OR OTHERWISE WITH RESPECT TO THE SERVICE OR THE SITE. RentMeAHandbag Inc SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. RentMeAHandbag Inc DOES NOT WARRANT THAT YOUR USE OF THE SERVICE OR THE SITE WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE OR ERROR-FREE OR FREE OF OMISSIONS, OR WILL MEET YOUR REQUIREMENTS, THAT THE SERVER WHICH MAKES THE SITE AVAILABLE WILL BE FREE OF VIRUSES, MALICIOUS CODE, OR OTHER HARMFUL ELEMENTS, OR THAT ANY DEFECTS IN THE SERVICE OR THE SITE WILL BE CORRECTED.  RentMeAHandbag Inc DISCLAIMS ALL LIABILITY AND/OR RESPONSIBILITY FOR ANY INTERRUPTIONS OR DELAYS IN THE SHIPMENT OF PRODUCTS, DELIVERY OR TRANSMISSION OF SITE CONTENT, ANY LOSSES OR DAMAGES ARISING FROM THE USE OF THE SITE OR THE SERVICE, OR CONDUCT BY USERS OF THE SITE OR SUBSCRIBING MEMBERS OF RentMeAHandbag Inc IN ITS SOLE DISCRETION, RentMeAHandbag Inc RESERVES THE RIGHT TO REFUSE TO SHIP PRODUCTS.

NOTWITHSTANDING ANY CONTRARY PROVISION HEREIN BUT SUBJECT TO THE FOREGOING LIMITATION ON LIABILITY, IN ALL EVENTS RentMeAHandbag Inc LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO RentMeAHandbag Inc FOR THE SERVICE DURING THE MONTH or Week OF MEMBERSHIP THAT SUCH DAMAGES OCCURED.

12. Indemnity

You agree to indemnify and hold RentMeAHandbag Inc, its shareholders, directors, officers, investors, or employees harmless from any claim or demand, including reasonable attorneys' fees made by any third party due to or arising from the use, proximity, placement and/or handling of one of the rented items. Furthermore, you also agree to indemnify RentMeAHandbag Inc, its shareholders, directors, officers, investors, and employees for any damages or loss of any kind incurred by you due to or arising from as the use, proximity, placement, and/or handling of items rented to you.

13. Intellectual Property

All content on the Site is property of RentMeAHandbag Inc or its Product Suppliers, and is protected by United States and International Copyright Laws.  Such content includes, but is not limited to, logos, graphics, photographs, designs, diagrams, images, icons, buttons, video clips, audio clips, sound logos, digital downloads, data compilations, software, or any compilation of any of the above.  You may not download, reproduce, distribute, offer for sale, create derivative works from, republish, reverse engineer, retransmit, copy, post, upload or otherwise use or exploit the content of the site including, but not limited to, the materials listed above, without our prior written consent. This also includes, but is not limited to "framing" of any part of the Site, or tampering with our software or the functionality of this Site, to reverse engineer or to circumvent the navigation of the Site.  You also may not use any robot, spider, or other automatic device or manual process to monitor the Site without our prior written consent.

RENTMEAHANDBAG and Rentmeahandbag.com are trademarks of RENTMEAHANDBAG Inc.  Our trade marks and corporate identity include, but are not limited to all RentMeAHandbag logos, sound logos,  fonts, buttons, icons, text, descriptions, slogans, page headers and footers, color schemes, service names, and the "look" and "feel" of the Site, and they may not be used in any way, shape or form that may cause confusion among members, customers, prospective customers, or other parties, or in any other way that may negatively affect RentMeAHandbag.   Trademarks of other companies, brands, or Product suppliers, which may or may not be affiliated with RentmeAHandbag, are not the property of RentMeAHandbag and they remain the property of their respective owners.  We neither warrant nor represent that your use of materials displayed on the Site will not infringe the rights of third parties not owned by, or affiliated with, RentMeaHandbag.

14. Termination

RentMeAHandbag reserves the right to terminate or restrict your membership and/or use of the Site, and/or any and all services related to your membership, without notice, for any or no reason whatsoever.

15. Links and Advertising

We may provide, or third parties may provide, links to other Web sites or resources that are beyond our control. We make no representations as to the quality, suitability, functionality, or legality of any sites to which links may be provided, and you hereby waive any claim you might have against us, with respect to such sites. RentMeAHandbag IS NOT RESPONSIBLE FOR THE CONTENT ON THE INTERNET OR WEB PAGES THAT ARE CONTAINED OUTSIDE THE SITE.

16. Copyright Infringement

We respect the intellectual property of others, and we ask our renters and Site users to do the same. However, in the event that you believe that a copyright infringement has otherwise occurred, please notify us immediately at

17. Taxes

All applicable local, city, and state taxes are your responsibility. Where applicable, you agree to pay these taxes.
